Missouri Governor Signs Legislation Authorizing Tax Amnesty

On April 27, 2015, Missouri Governor Jay Nixon signed legislation that will authorize and create a tax amnesty program that will waive all penalties, additions to tax, and interest. The tax amnesty program will run from September 1, 2015 to November 30, 2015. The amnesty only applies to tax liabilities that are due but unpaid on or before December 31, 2014. Only tax payments made between September 1, 2015 and November 30, 2015 will be allowed amnesty. The amnesty program will not be allowed for any taxpayer that is a party in any criminal investigations or to any civil or criminal litigations pending in any court in the United States or in Missouri.
Amnesty will only be granted taxpayers if all of the following is fulfilled:
- those who have applied for amnesty within the specific time period stated above;
- who have filed a tax return for each taxable period for which amnesty is requested;
- who have paid the entire balance by November 30, 2015; and
- must agree to comply with the state laws for the next 8 years.
Should any taxpayer fail to comply with the state’s tax laws for the next eight years, all penalties, interest, and additional tax that were waived will be due immediately. No taxpayer that is granted amnesty will be eligible to participate in any future amnesty programs for the same tax type.
