Maryland Releases Information Regarding 2015 Tax Amnesty Program

The Comptroller of Maryland recently released information regarding their 2015 Tax Amnesty Program.  The program will run from September 1, 2015 through October 30, 2015.  This program waives all civil penalties and one half of the interest for delinquent taxpayers who apply and are approved.  Everything that a delinquent taxpayer would need to file such as the tax amnesty application, tax amnesty calculator, and Tax Amnesty BillPay will be available starting August 28, 2015.   Applications will start to be accepted on September 1, 2015.

The following taxes will be eligible for amnesty:

  • Personal income tax,
  • Fiduciary income tax,
  • Pass-through entity nonresident income tax,
  • Corporate income tax,
  • Employer withholding tax,
  • Sales and use tax, and
  • Admissions and amusement tax.

There are a couple of limitations as to who can be granted amnesty.  Taxpayers who were granted amnesty in either 2001 or 2009 are not eligible.  In addition, those taxpayers who were eligible for the Delaware Holding Company settlement established by Chapter 577 of the Actos of 2004 for tax periods prior to tax-year 2003 are also not eligible.

Regarding payment, any tax payer who submits an application may elect to pay their outstanding debt in full at the time of application or may pay 10% of the amnesty amount due and set up a payment plan.
